Title

Authority to grant a 25-year, 464.5 sq. ft. non-exclusive easement to Commonwealth Edison Company to install, construct, operate, maintain, repair and replace an overhead electrical transmission line and two (2) wood utility poles to supply electricity to McCook Development’s overhead electrical transmission lines located within the western portion of Main Channel Parcel 35.05 in McCook, Illinois.  Consideration shall be an initial annual fee of $5,000.00

Dear Sir:

 

McCook Development leases 42 acres of District real estate located at 5330 South Lawndale Avenue, in McCook, Illinois, known as Main Channel Parcel 35.05 (“Parcel 35.05”) for depositing excavated materials, storage of dry and liquid materials and construction and operation of a truck terminal.  The lease commenced November 1, 1950 and expires October 31, 2059.  McCook Development desires to improve its leasehold by bringing electrical power to the western portion of its site. 

 

Accordingly, Commonwealth Edison Company (“ComEd”) has requested a 25-year, 464.5 sq. ft. non-exclusive easement to install, construct, operate, maintain, repair and replace a new overhead electrical transmission line and two (2) wood utility poles to supply electricity to this section of McCook Development’s leasehold.  ComEd operates an overhead electrical transmission line and wood utility poles located along the west line of Parcel 35.05 under a perpetual easement that commenced December 13, 1951.  ComEd paid a one-time easement fee of $1,000.00.  ComEd will connect to its existing electrical transmission line to add this additional electricity.

 

The District’s technical departments have reviewed ComEd’s request and have no objections thereto.  An initial annual easement fee of $5,000.00 is recommended, as 10% of the fair market value of the easement premises would yield a fee less than the District’s minimum easement fee of $5,000.00.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the grant of a 25-year, 464.5 sq. ft. non-exclusive easement to Commonwealth Edison Company to install, construct, operate, maintain, repair and replace an overhead electrical transmission line and two (2) wood utility poles to supply electricity to McCook Development’s overhead electrical transmission lines located within the western portion of Main Channel Parcel 35.05 in McCook, Illinois.  Consideration shall be an initial annual fee of $5,000.00.

 

It is also requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said easement agreement after it is approved by the General Counsel as to form and legality.
