Dear Sir:
 
The Illinois State Toll Highway Authority ("ISTHA") has requested a permit to access 21,800 square feet of District real estate within that part of the Kirie Reclamation Plant located east of Elmhurst Road between Willie Road and Oakton Street in Des Plaines, Illinois, for staging and to rehabilitate the Higgins Creek Bridge and to relocate a 24" water main.  The water main, once relocated, will remain on District property.  The water main is owned by and under easement to the Northwest Suburban Municipal Joint Action Water Agency ("Water Agency").  The permit is therefore subject to the Water Agency's consent.  The bridge work and the relocation of the water main are part of the construction of the Elgin-O'Hare Western Access Project ("Project").  
 
The District is coordinating with ISTHA on certain aspects of the Project as it affects parcels of real estate located along or near I-90 and Elmhurst Road.  Ultimately, staff will be seeking approval from the Board of Commissioners to enter into an Intergovernmental Agreement with ISTHA, as ISTHA is in the process of identifying which parcels of District real estate are necessary to purchase as part of the Project including the subject 21,800 square feet of land.
 
The District's technical departments have reviewed this request and have no objections to issuing the permit to ISTHA.  A nominal fee of $10.00 is recommended as is customary with governmental entities using District property for public purposes.  
 
It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and approve the issuance of a nine (9) month permit to the Illinois State Toll Highway Authority on approximately 21,800 square feet of District real estate located east of Elmhurst Road between Willie Road and Oakton Street in Des Plaines, Illinois for staging, the rehabilitation of the Higgins Creek Bridge and the relocation of a 24" water main in connection with the Elgin-O'Hare Western Access Project.  Consideration shall be a nominal fee of $10.00.
It is further requested that the Executive Director recommend to the Board of Commissioners that it authorize the Chairman of the Committee on Finance and the Clerk to execute the permit agreement after it has been approved by the General Counsel as to form and legality.
