Authority to execute a Structure Assignment Agreement between Metropolitan Water Reclamation District of Greater Chicago and City of Chicago for transfer of the sewer system located at West Peterson Avenue Right of Way approximately 150 feet west of the North Shore Channel in Chicago, Illinois, pursuant to Sewer Connection Authorization No. 12-CH-02

Dear Sir:
In May 2012, MWRD approved issuance of a sewer connection authorization to the City of Chicago as part of the "W. Peterson Ave. - N. Lincoln Ave. to N. Artesian Ave.; N. Fairfield Ave. - W. Peterson Ave. to W. Granville Ave. Project", including improvements that would require modification of existing City of Chicago sewer connections to MWRD Connection Structure and East Siphon Structure. Special Condition No. 16 for MWRD Sewer Construction Authorization No. 12-CH-02 requires the transfer of ownership of all sewer and structures between MWRD's TARP Connecting Structure and the East Siphon Chamber from the City of Chicago to MWRD. The City of Chicago and MWRD have reached an agreement transferring ownership of the sewer and structures. Consideration is a nominal fee of $10.00.
Accordingly, it is respectfully requested that the Executive Director recommend to the Board of Commissioners that it authorize and approve the execution of the Sewer System Assignment Agreement for Sewer Construction Authorization No. 12-CH-02, upon the terms and conditions referenced above.
It is further respectfully requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute the Structure Assignment Agreement on behalf of MWRD after same is approved by the General Counsel as to form and legality.
