Dear Sir:
 
On June 5, 2003, the District entered into a Permit Agreement with Illinois Mining Corp., n/k/a IM Crushing, LLC ("IM Crushing") authorizing it to use approximately 41.22 acres of District real estate located south of the Cal-Sag Channel, between Cicero and Kostner Avenues in Crestwood, Cook County, Illinois, and known as Cal-Sag Channel Parcel 12.05 for the sole and exclusive purpose of mining, removing and selling channel excavation rock for the period commencing November 1, 2003, and expiring October 31, 2008.  The Permit Agreement was extended multiple times from November 1, 2008, through October 31, 2014.  IM Crushing has excavated and removed approximately 50% of the channel excavation rock or approximately 700,000 cubic yards over this time period.
 
IM Crushing did not vacate Parcel 12.05 upon expiration of its permit on October 31, 2014.  Certain equipment, materials and debris remain on site that IM Crushing is required to remove.  IM Crushing requested an additional month to remove the remaining items and material from the site.  It was in the District's best interests to allow IM Crushing the additional time it requested so that the site can be properly vacated.
 
Additionally, the District recently received a request from the Village of Crestwood ("Crestwood") for a two (2) year permit on Parcel 12.05 to remove the remaining piles of channel excavation rock so that the property can ultimately be leased through the statutory leasing process and developed for commercial use.  A companion letter seeking authority to issue a two (2) year permit to Crestwood is on today's agenda.
 
At the time the Executive Director issued the permit extension, he polled the Board of Commissioners and found that it was amenable to its issuance.
 
It is requested that the Board of Commissioners ratify the Executive Director's action of October 31, 2014 issuing a one (1) month permit extension to IM Crushing, LLC for the sole and exclusive purpose of removing all of its material, equipment and debris from approximately 41.22 acres of District real estate located south of the Cal-Sag Channel, between Cicero and Kostner Avenues in Crestwood, Cook County, Illinois and known as Cal-Sag Channel Parcel 12.05 for consideration of a nominal fee of $10.00.
