Title

Authority to issue a nine (9) month permit to Peoples Gas on an approximately 5' x 270' area of District real estate located along the southern boundary of the 95^th Street Pumping Station Site for construction staging purposes.  Consideration shall be $10.00

Dear Sir:

Peoples Gas is remediating its property at Baltimore Avenue and 96^th Street, adjacent to the District's 95^th Street Pumping Station at Baltimore Avenue and 95^th Street in Chicago ("Pumping Station Site"). The Peoples Gas site is a former Manufactured Gas Plant ("MGP") site.  Peoples Gas has indicated that, as part of its remediation, it will be installing sheet piling inside its property line.  Peoples Gas is, therefore, requesting a permit to temporarily relocate its current fence 5 feet onto the Pumping Station Site for approximately 6 months.  A companion Board letter is on today's agenda seeking authority to issue a one-year permit to Peoples Gas to conduct an environmental site investigation on the Pumping Station Site.

Peoples Gas has stated that no heavy equipment will be used or stored on the District's property.  All cranes and excavators for the remediation will be located on Peoples Gas' property.  Construction personnel will need access to walk on the District's property, located within the relocated fence line, and certain equipment will be used on the Pumping Station Site to install the temporary fence.  Upon completion of the installation of the sheet piling, the temporary fence will be removed from the Pumping Station Site, and the permanent fence will be replaced on Peoples Gas' property.

The District's technical departments have reviewed the subject requests and have no objections thereto.

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and approve the issuance of a nine (9) month permit to Peoples Gas on an approximately 5' x 270' area of District real estate located along the southern boundary of the 95^th Street Pumping Station Site for construction staging purposes.  Consideration shall be $10.00.

It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said permit agreement on behalf of the District after it is approved by the General Counsel as to form and legality.
