Dear Sir:
 
At its meeting of May 4, 2000, the District's Board of Commissioners authorized the grant of an easement to Commonwealth Edison Company ("ComEd") on 9.370 acres of District real estate located east of Lawndale Avenue from a point north of the Des Plaines River in McCook to a point south of the Main Channel in Summit to operate, maintain, repair and remove two 345kv electrical transmission lines ("Easement").  The Easement expires in 2035.  The current annual Easement fee is $32,245.00.  ComEd has requested an amendment to the Easement to allow it to install, maintain, operate and remove 128kv electrical transmission lines within the current easement area.  Because the Easement only allows for the installation of 345kv lines, an amendment is necessary to allow for the installation of 128kv lines.  The 128kv lines will run perpendicular to the 345kv lines and will run in an east/west direction on the northernmost section of Main Channel Parcel 35.05.
 
The technical departments have reviewed ComEd's request for an amended Easement and have no objections thereto.  The District's standard document preparation fee shall be charged in this transaction.
 
It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and approve an amendment of the Easement Agreement dated May 4, 2000, between the District and Commonwealth Edison Company on 9.370 acres of District real estate located east of Lawndale Avenue from a point north of the Des Plaines River on Main Channel Parcel 35.05 in McCook to a point  south of the Main Channel on Main Channel Parcel 34.03 in Summit to allow for the installation, maintenance, operation and removal of 128kv electrical transmission lines.  Consideration shall be a document preparation fee of $2,500.00.
 
It is further requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said easement amendment agreement on behalf of the District after it is approved by the General Counsel as to form and legality.
