Title
Authority to issue a three (3) year permit to the Illinois State Toll Highway Authority to widen and extend an existing access road located west of Higgins Road at the Majewski Reservoir Site in Elk Grove Village, Illinois to remove approximately five hundred thousand (500,000) cubic yards of soil for roadway improvement work in connection with the construction of the O'Hare Western Access Project. Consideration shall be a nominal fee of $10.00

Dear Sir:
The Illinois State Toll Highway Authority ("ISTHA") has requested a permit to widen and extend an existing access road located west of Higgins Road at the Majewski Reservoir Site to remove approximately five hundred thousand (500,000) cubic yards of soil for roadway improvement in connection with the construction of the O'Hare Western Access Project, ("Project").
Pursuant to an Intergovernmental Agreement entered into among ISTHA, the District and the Mt. Prospect Park District ("Park District") on September 4, 2014, ISTHA agreed to remove the referenced soils as part of the Project. The Park District leases the area that contains the soil piles under a lease that commenced in 2000 and expires in 2050 for public recreational use. The soil will be removed by ISTHA at no cost to either the District or the Park District. ISTHA will ensure that the removal of the soil will result in grade elevation acceptable for recreational development by the Park District. A companion transmittal letter is being submitted to the Board amending the Park District's lease to extend the time for the Park District to develop its leasehold after the removal of the soil piles are completed.
The District's technical departments have reviewed this request and have no objections to issuing the permit to ISTHA. A nominal fee of $10.00 is recommended as is customary with governmental entities using District property for public purposes.
It is requested that the Executive Director recommend to the Board of Commissioners that it issue a three (3) year permit to the Illinois State Toll Highway Authority to widen and extend an existing access road located west of Higgins Road at the Majewski Reservoir Site in Elk Grove Village, Illinois to remove approximately five hundred thousand (500,000) cubic yards of soil for roadway improvement work in connection with the construction of the O'Hare Western Access Project. Consideration shall be a nominal fee of $10.00.
It is further recommended that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute the permit after it is approved by the General Counsel as to form and legality.
