Authorization to amend the Intergovernmental Agreement with the Village of Wheeling and the Wheeling Park District for the construction of stormwater storage facilities and improvements to Heritage Park

Dear Sir:
 
On April 1, 2010, the District entered into an Intergovernmental Agreement (IGA) with the Village of Wheeling (Village) and the Wheeling Park District (WPD) for the construction of stormwater storage facilities and improvements at Heritage Park.
 
As a condition of the IGA, the Village is required to provide a direct hydraulic connection into Lake Heritage in order to utilize any portion of the available 10 acre-feet of detention storage.  The connection must be capable of conveying 100-year flow from any new development or redevelopment site seeking to utilize the available detention storage for its own site detention storage requirements.
 
Since the IGA was executed, the District adopted the Watershed Management Ordinance (WMO), regulating site development and stormwater detention for suburban Cook County.  The WMO became effective May 1, 2014, and includes specific provisions to allow for reasonable "detention trading".  Given certain site limitations, as specified under the hierarchy noted in §504.14 of the WMO, detention may be built and provided offsite without a direct hydraulic connection.  However, the WMO also requires, per §500.7, that existing intergovernmental agreements prevail over the requirements of the ordinance, including this Wheeling IGA.
 
Based on the foregoing, it is respectfully requested that the Board of Commissioners grant authority to amend the IGA and allow for reasonable "detention trading" according to the requirements outlined under the WMO.  It is also requested that the Chairman of the Committee on Finance, and the Clerk be authorized and directed to execute the proposed amended agreement on behalf of the District after it is approved by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.
