Dear Sir:
 
On August 8, 2013, the Board of Commissioners authorized the Director of Procurement and Materials Management to award Contract 11-054-3P Disinfection Facilities, Terrence J. O'Brien Water Reclamation Plant, to Walsh Construction Company II, LLC, in an amount not to exceed $59,899,650.00 plus a five (5) percent allowance for change orders in an amount of $2,994,982.50, for a total amount not to exceed $62,894,632.50. The scheduled contract completion date is December 19, 2015.
 
As of June 5, 2015, the effect of these change orders resulted in a net increase in the amount of $976,113.97 from the original amount awarded of 59,899,650.00. The current contract value is $60,875,763.97. The prior approved change orders reflect a 1.63% increase to the original contract value.
 
The engineer has determined that revisions to the Commonwealth Edison (ComEd) scope of work are required to restore ComEd services that were damaged due to the earth retention system and CTA embankment failure. Allowance Item Cost Proposal E for ComEd work has been fully utilized and needs to be increased in order to accommodate this work. The proposal submitted by ComEd (CCO-032) to be paid for under Allowance Item Cost Proposal E is for work necessary to restore these ComEd services. The scope of work includes the removal of existing poles, wood arms, dead ends, and wires; the installation of new 40' tall poles for 34kV downfeed taps; directional boring 227 feet to install 2-6" polypipes under the CTA tracks and directional boring 135 feet to install 1-6" polypipe between an existing manhole and power pole; and the installation of 1670 feet of 1-3/C-750CU EXFSJ 34kV cable. The contractor submitted a cost proposal (CCO-032) for an extra in the amount of $695,950.84. The engineer reviewed the proposal, found it to be reasonable, and stated via correspondence 1153, that the Engineering Department would recommend its approval.
 
This change order is in compliance with the Illinois Criminal Code since the change is germane to the contract.
 
The District has reserved its rights to seek contribution for any such claims and reimbursement for this requested increase from all responsible parties.
 
Additional claims may be forthcoming for emergency work performed by ComEd immediately following the earth retention system and CTA embankment failure.
 
It is hereby recommended that the Board of Commissioners authorize the Director of Procurement and Materials Management to execute a change order to increase Contract 11-054-3P in an amount of $695,950.84 (1.14% of the current contract value), from an amount of $60,875,763.97, to an amount not to exceed $61,571,714.81.
 
Funds are available in Account 401-50000-645650.
