Dear Sir:

 

On Monday, June 1, 2015, in accordance with Section 11.5 of the Purchasing Act, the Director of Engineering declared a bonafide operating emergency and authorized Contract 15-070-9P, Emergency Investigation relating to Skokie, IL Embankment Collapse, to Construction Technology Laboratories, Inc., in an amount not to exceed $50,000.00.  The scheduled contract completion is December 31, 2015.

 

This contract has no prior change orders.

 

On Sunday, May 17, 2015, the embankment under the Chicago Transit Authority’s (“CTA”) Yellow Line collapsed.  This embankment is adjacent to the work being done by Walsh Construction Company II, LLC under District Contract 11-054-3P, Disinfection Facilities at O’Brien Water Reclamation Plant (the “Contract”).  The CTA’s yellow line is currently out of service, and work on the Contract has been impacted.

 

Under the emergency declaration, the District retained Construction Technology Laboratories, Inc. (“CTL Group”) for technical consulting services to investigate this embankment collapse and to facilitate the continuation of the Contract work on the disinfection facilities at the District’s O’Brien Water Reclamation Plant.  CTL Group was available to provide service immediately, and under this agreement, they continue to perform site inspections, review relevant documents, synthesize its observations, perform engineering analysis, and will prepare a report summarizing their investigative findings.

 

CTL Group has been performing this work for the District on a time and materials basis. As the majority of the funds encumbered under the emergency declaration have been utilized, additional funds are necessary to continue and complete the work required. The estimated cost for the remaining work is an increase of $50,000.00 over the original $50,000.00 emergency authorization.

 

This change order is in compliance with the Illinois Criminal Code since the change is germane to the original contract.

 

It is hereby recommended that the Board of Commissioners authorize the Director of Procurement and Materials Management to execute a change order to increase Contract 15-070-9P, in an amount of $50,000.00 (100% of the current contract value) from an amount of $50,000.00 to an amount not to exceed $100,000.00.

 

Funds are available in Account 901-30000-667220.
