Authority to approve and execute an Air Rights Agreement with the Illinois Department of Transportation, for the Des Plaines Inflow Tunnel, SSA (ROW File No. 13, Contract 13-106-4F)

Dear Sir:
In connection with the Des Plaines Inflow Tunnel contract, it is necessary to execute an Air Rights Agreement with the Illinois Department of Transportation for construction, operation, and maintenance of a 20-foot diameter tunnel which will convey storm flows from the Des Plaines leg of the Deep Tunnel to the McCook reservoir under the Stevenson Expressway (Interstate 55). The Air Rights Agreement is required for work occupying State highway right-of-way.
It is requested the Executive Director recommend to the Board of Commissioners that it accept and approve the Air Rights Agreement with the Illinois Department of Transportation, in connection with the captioned project, and that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said Air Rights Agreement on behalf of the District after it is approved by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.
