Dear Sir:

 

In connection with the Des Plaines Inflow Tunnel project, it is necessary to acquire a permanent subterranean easement from the BNSF Railway Company (BNSF) for the construction, operation, and maintenance of a 20-foot diameter tunnel which will convey storm flows from the Des Plaines leg of the Deep Tunnel to the McCook reservoir.  BNSF indicated that it is willing to grant an easement to the District subject to the review of the District’s engineering plans to ensure the proposed tunnel construction will not affect their property and facilities.  In order to initiate this review, the District needs to execute an agreement with BNSF and make payment to them for their review fee. BNSF has provided a cost estimate for a third party review to be performed by its engineering consultant, McMillen Jacobs Associates, in an amount of $9,980.00.

 

It is hereby requested that the Executive Director recommend that the Board of Commissioners grant its authority to execute an agreement with the BNSF Railway Company in connection with their review of the engineering plans for the captioned project, and make payment to BNSF in an amount not to exceed $9,980.00 for their engineering review fee.

 

 It is further respectfully requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said agreement with BNSF on behalf of the District after it is approved by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.

 

Funds are available in Account 401-50000-601410.
