Dear Sir:

 

The Illinois State Toll Highway Authority (ISTHA) is widening the Jane Addams Tollway (I-90) and reconstructing the interchange at Elmhurst Road.  To ensure that there are no conflicts with the new roads and facilities and to ensure District access, approximately 1,000 feet of the O’Hare-Egan Solids Pipeline must be moved and reconstructed.  The District and ISTHA entered into an intergovernmental agreement dated September 14, 2014, which authorized ISTHA right-of-way purchase from the District, ISTHA removal of spoil at the Majewski Reservoir site for use on its O’Hare West Bypass project, and relocation of a segment of the sludge line.  Although the District is being compensated fair market value for sale of the right-of-way, the District is by law and by previous permit financially responsible for the relocation of its facilities within the right-of-way.

 

ISTHA has designed and will construct the sludge line relocation in conjunction with its roadway construction.  Design and construction is based on District standards, and the District has approved the final plans, specifications, and bid prices.  Furthermore, the District will monitor construction to ensure District standards are met. 

 

The intergovernmental agreement included a construction cost estimate of $313,880.52, which contains engineering and mobilization costs less an amount for related work performed by the District.   The ISTHA contract has been awarded, and final bid prices less District work performed totals $330,252.47.  Construction is scheduled to begin April 1, 2016, with a completion date of June 30, 2016.

 

According to the intergovernmental agreement, upon award of the ISTHA contract, the District will pay by direct voucher 50 percent of the actual bid price with the remainder upon completion and inspection of the work and determination of the final costs.  Should the actual cost of the work exceed $330,252.47, an additional request to the Board of Commissioners would be made after review by the Engineering Department. 

 

Based on the foregoing, it is requested that the Board of Commissioners grant authority to make payment, by direct vouchers, in an amount not to exceed $330,252.47 to ISTHA for the reconstruction of a segment of the District’s sludge line.

 

Funds are available in account 401-50000-645700.
