Title

Authority to issue a five (5) year permit extension to Waste Management of Illinois, Inc. to continue to install, maintain, operate and remove monitoring wells on District real estate located at 2025 E. 134th Street in Chicago, Illinois.  Consideration shall be an annual fee of $5,000.00.

Dear Sir:

 

Waste Management of Illinois, Inc. (“Waste”) owns a recycling, disposal and landfill facility located at 138th and Interstate 94 in Calumet City.  The facility has been closed for several years but is under a long-term post-closure monitoring program.  The facility is located adjacent to and south of District real estate located at 2025 East 134th Street.  The IEPA required Waste to install a number of groundwater monitoring wells on the District's property around the perimeter of the landfill for the purpose of monitoring groundwater quality off of the landfill site property.  In response thereto, on October 6, 2011, the District issued a five (5) year permit to Waste to enter the subject District land to install, maintain, operate and remove monitoring wells and perform any necessary environmental remediation.  The permit expires October 16, 2016 and is subject to an annual fee of $2,500.00.  Waste has requested to continue to maintain its monitoring wells along the perimeter of the District’s property for an additional five years.  The subject property is currently under lease to the Chicago Park District for public recreational use.  This permit extension will therefore require the Chicago Park District’s consent. 

 

A Phase II Environmental Assessment on the District’s property indicated there is contamination in the groundwater potentially due to migration from the landfill.  Monitoring well data indicates the presence of at least one contaminant, Dioxane, above the Class I groundwater standards.  The two deeper bedrock monitoring wells have had no detections of any contaminants above the Class I groundwater standards.  The permit extension will require monitoring and that the appropriate soil and groundwater standards are met. 

 

The technical departments have reviewed this request and have no objections to Waste’s continued access to the land for this purpose.  The annual permit fee of $5,000 is based upon the District’s minimum annual fee since the permit area is of minimal size and the District’s customary assessment of fees of 10% of the fair market value would yield less than the minimum annual fee.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and approve the issuance of a 5-year permit extension to Waste Management of Illinois, Inc. to continue to install, maintain, operate and remove monitoring wells and perform any necessary environmental remediation on District real estate located at 2025 E. 134th Street in Chicago, Illinois.  Consideration shall be an annual fee of $5,000.00.

 

It is further requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said permit extension after same is approved by the General Counsel as to form and legality.
