Title

Authority to grant a 25-year, 2,140.6 sq. ft. non-exclusive easement to Commonwealth Edison Company to continue to install, operate, maintain, and remove its electrical transmission lines through District real estate located south of the Emerson Street bridge, between McCormick Boulevard and Leland Avenue in Skokie and Evanston; North Shore Channel Parcels 3.03 and 3.05. Consideration shall be an initial annual fee of $5,000.00

Dear Sir:

 

On March 28, 1946, the District granted the Public Service Company of Northern Illinois, predecessor in rights to Commonwealth Edison Company (“ComEd”) the right to enter District land to install electric transmission lines consisting of three (3) power poles with wires across the North Shore Channel located south of the Emerson Street bridge between McCormick Boulevard and Leland Avenue and known as North Shore Channel Parcels 3.03 and 3.05.  ComEd is proposing to add additional wires and is therefore requesting a 25-year easement to continue to operate and maintain its electrical transmission lines at the subject location.  Parcel 3.03 is currently under lease to the City of Evanston and Parcel 3.05 is under lease to the Village of Skokie. 

 

The District’s technical departments have reviewed ComEd’s request for a new easement and have no objections thereto.

 

It is recommended that an initial annual fee of $5,000.00 be assessed as 10% of the fair market value fee of the easement premises would yield a fee less than the District's minimum fee of $5,000.00.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the grant of a 25-year, 2,140.6 sq. ft. non-exclusive easement to Commonwealth Edison Company to continue to install, operate, maintain, and remove its electrical transmission lines through District real estate located south of the Emerson Street bridge, between McCormick Boulevard and Leland Avenue in Skokie and Evanston; North Shore Channel Parcels 3.03 and 3.05. Consideration shall be an initial annual fee of $5,000.00.

 

It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said easement agreement on behalf of the District after it is approved by the General Counsel as to form and legality.
