TRANSMITTAL LETTER FOR BOARD MEETING OF MAY 5, 2016

COMMITTEE ON REAL ESTATE

Mr. David St. Pierre, Executive Director

Title

Ratify the action of the Executive Director on April 29, 2016, issuing a 90-day permit to the Northwest Suburban Municipal Joint Action Water Agency to access the Majewski Reservoir to dewater its adjacent water main and to perform erosion control repair work.  Consideration shall be a documentation fee of $5,000.00

Body

Dear Sir:

The Northwest Suburban Municipal Joint Action Water Agency (“JAWA”) operates a 72” water main located along the south fence line of the Majewski Reservoir (“Reservoir”) under an easement dated May 19, 1983 that commenced on May 19, 1983 and expires May 18, 2033.  The annual easement fee is $1,904.24.  The water main is leaking due to a break. As a result of the break there has been erosion at the top of the slope of the Reservoir.

JAWA requested permission to access the Reservoir to dewater its adjacent water main and perform erosion control work by placing a PVC pipe adjacent to the water main so that water can be pumped and emptied into the Reservoir allowing for the repair of the water main and to perform erosion repairs to the slope of the Reservoir.  The issuance of a permit was therefore necessary due to the urgency of the nature of the repair work to the water main and to the Reservoir.

At the time the Executive Director issued the permit, he polled the Board of Commissioners and found that it was amenable to its issuance.

Accordingly, it is requested that the Board of Commissioners ratify and approve the action of the Executive Director of April 29, 2016, issuing a 90-day permit to the Northwest Suburban Municipal Joint Action Water Agency to access the Majewski Reservoir (“Reservoir”) to dewater its adjacent water main and to perform erosion control repair work.  Consideration shall be a documentation fee of $5,000.00.

Requested, Ronald M. Hill, General Counsel, RMH:STM:MLD:vp

Recommended, David St. Pierre, Executive Director

Respectfully Submitted, Mariyana T. Spyropoulos, Chairman Committee on Real Estate Development
