Authority to enter into an intergovernmental agreement with the City of Burbank and the Village of Oak Lawn for the design, construction, and maintenance of the Melvina Ditch Reservoir Improvements in Burbank, Illinois

Dear Sir:

 

Authorization is requested to enter into an Intergovernmental Agreement (IGA) with the City of Burbank (City) and the Village of Oak Lawn (Village) for the Melvina Ditch Reservoir Improvements in Burbank, Illinois to establish certain responsibilities associated with the design, construction, and maintenance of the improvements associated with the proposed expansion of the Melvina Ditch Reservoir.

 

On May 7, 2015, the Board of Commissioners authorized the District to negotiate an intergovernmental agreement with the City of Burbank and the Village of Oak Lawn for the above captioned project, which consists of horizontal and vertical expansion of the District’s Melvina Ditch Reservoir and associated pump station improvements to address flooding in the City and Village. The project, once constructed, will significantly increase the capacity of the existing reservoir and reduce water surface elevations and downstream overflows in the Melvina Ditch watershed. The parties have agreed in principle to the terms of the IGA, which include design and construction of the reservoir improvements by the District, and future maintenance of the grounds and new stormwater improvements at the reservoir site by the City upon completion of the reservoir expansion work. In addition, the IGA requires the City and the Village to commit a minimum of $4,889,500.00 and $1,460,500.00, respectively, over a maximum 10-year period toward future stormwater infrastructure improvements.

 

Based on the foregoing, it is requested that the Board of Commissioners grant authority for the District to enter into an IGA with the City of Burbank and the Village of Oak Lawn for the Melvina Ditch Reservoir Improvements project.  It is further requested that the Chairman of the Committee on Finance, the Executive Director, and the Clerk be authorized to execute said agreement on behalf of the District, as well as any documents necessary to effectuate the transaction and conveyance, upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.
