Title
Authority to grant a 25-year, non-exclusive easement to Commonwealth Edison Company to install, operate, maintain, repair and replace electrical transmission lines onto the District’s Touhy Avenue Bridge and continue to maintain and operate existing electrical lines and appurtenances related thereto. Consideration shall be an initial annual rental fee of $5,000.00

Dear Sir:
On February 19, 1931, the District granted Commonwealth Edison Company, successor in interest to The Public Service Company of Northern Illinois (“ComEd”) the right to install, maintain, and operate electrical transmission lines and appurtenances related thereto on the District’s Touhy Avenue Bridge (“Bridge”).
ComEd is now requesting a 25-year easement to install, operate, maintain, repair, replace, and remove additional transmission lines and equipment on the Bridge. Any new easement grant will also include the existing electrical lines and appurtenances related thereto located on the Bridge under the 1931 authorization.
The District’s technical departments have reviewed ComEd’s request for an easement and have no objections thereto.
It is recommended that an initial annual rental fee of $5,000.00 be assessed as 10% of the fair market value fee of the easement premises would yield a fee less than the District's minimum fee of $5,000.00.
It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the grant of a 25-year, non-exclusive easement to Commonwealth Edison Company to install, operate, maintain, repair and replace electrical transmission lines onto the District’s Touhy Avenue Bridge and continue to maintain and operate existing electrical lines and appurtenances related thereto. Consideration shall be an initial annual rental fee of $5,000.00.
It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said easement agreement on behalf of the District after it is approved by the General Counsel as to form and legality.
