Dear Sir:
On September 1, 2016, the Board of Commissioners authorized the Director of Procurement and Materials Management to advertise for bids, Contract 16-005-11 furnish and deliver pallets to various locations for a one (1) year period, beginning approximately October 1, 2016 and ending September 30, 2017.
On October 20, 2016, the Board of Commissioners authorized the award of Contract 16-005-11, Group B, to Atlas & Associates, Inc., to furnish and deliver plastic pallets to various locations for a one (1) year period, in an amount not to exceed $95,850.00.
On October 25, 2016, purchase order number 3091790 was issued to Atlas & Associates, Inc., with a delivery due date of November 25, 2016. As of January 20, 2017, Atlas & Associates, Inc., has failed to deliver the material ordered. Several calls and emails were sent to Atlas & Associates, Inc., to perform on the contract and make delivery of the pallets. Atlas & Associates, Inc., has indicated that they cannot meet the terms of their supplier in order to make the deliveries. Therefore, the Director of Procurement and Materials Management has advised Atlas & Associates, Inc., that their contract will be forfeited in accordance with Section 70 ILCS 2605/11.11 of the Purchasing Act. Based on the fact that this is the second time that Atlas & Associates, Inc., has forfeited a contract, this firm will not be considered a responsible bidder for a two-year period.
In view of the foregoing, the Director of Procurement and Materials Management recommends the award of Contract 16-005-11, Group B, to Atlas & Associates, Inc., in an amount of $95,850.00, be forfeited. There is no bid deposit for this contract.
The contract for Group B will be re-advertised as soon as possible.
