Dear Sir:

 

On September 7, 2006, the Board of Commissioners ("Board") authorized the issuance of a two-year permit to Ashland LLC ("Ashland") to install, access and maintain monitoring wells on District land located between I-294 and Willow Springs Road, commonly known as "LASMA", to evaluate the groundwater conditions and possible migration of contamination downstream from its facility onto District land.  The permit, as extended and amended, expires December 31, 2017.  The current annual permit fee is $2,500.00. 

 

Ashland has requested a five-year extension to its permit to continue to monitor the wells.  Ashland is under a United States Environmental Protection Agency ("USEPA") Administrative Order, effective August 2007, to install a series of monitoring wells to continue well sampling activities to measure how far the contamination has moved from its source.  Ashland remediated the source of the contamination on its property.  Data and reports show that the contamination has not migrated on to District land.

 

The permit currently requires that Ashland provide the District with copies of all reports submitted to the USEPA and/or Illinois Environmental Protection Agency ("IEPA") relating to the monitoring wells on District property.  District staff continues to monitor site conditions through Ashland's reports to the IEPA at this time.

 

The technical departments have reviewed this request and have no objections to Ashland’s continued access to the land for this purpose.  An annual permit fee of $5,000.00 is recommended and is based upon the District’s minimum annual fee, since the permit area is of minimal size and the District’s customary assessment of fees of 10% of the fair market value would yield less than the minimum annual fee.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and approve the issuance of a 5-year permit extension to Ashland LLC to continue to access, monitor, repair and remove monitoring wells on the District's LASMA site located between I-294 and Willow Springs Road in Willow Springs, Illinois.  Consideration shall be an annual fee of $5,000.00.

 

It is further requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said permit extension after same is approved by the General Counsel as to form and legality.
