Mr. David St. Pierre, Executive Director

Title

Authority to grant a 25-year, 18,240± sq. ft. non-exclusive easement to the Village of Wilmette to continue to construct, reconstruct, operate, maintain, repair, replace and remove the Greenleaf Avenue Relief Sewer System on District North Shore Channel Parcel 1.05 located between Greenleaf Avenue and Sheridan Road in Wilmette, Illinois.  Consideration shall be a nominal fee of $10.00

Body

Dear Sir:

On April 1, 1993, the Board of Commissioners granted a 25-year, 18,240± sq. ft. non-exclusive easement to the Village of Wilmette (“Wilmette”) to construct, reconstruct, operate, maintain, repair, replace and remove a public sewer line consisting of a relief sewer, a by-pass structure and a relief sewer manhole for a nominal fee of $10.00.  The sewer line, commonly known as the Greenleaf Avenue Relief Sewer System, traverses North Shore Channel Parcel 1.05 between Greenleaf Avenue and Sheridan Road in Wilmette, Illinois.  The easement expires May 31, 2018.

Wilmette has requested a new 25-year easement to continue to operate and maintain the sewer line.  Parcel 1.05 is leased by the District to the Wilmette Park District for use as a public golf course known as Canal Shores.  The subject lease expires May 31, 2032.  Accordingly, Wilmette will also need to obtain the written consent of the Wilmette Park District to continue using this leasehold for the subject easement request.

The District’s technical departments have reviewed Wilmette’s request for an easement and have no objections thereto.  A nominal fee of $10.00 is recommended as is customary for governmental entities using District property for a public purpose.

It is requested that the Executive Director recommend to the Board of Commissioners that it grant a 25-year, 18,240± sq. ft. non-exclusive easement to the Village of Wilmette to continue to construct, reconstruct, operate, maintain, repair, replace and remove the Greenleaf Avenue Relief Sewer System on District North Shore Channel Parcel 1.05 located between Greenleaf Avenue and Sheridan Road in Wilmette, Illinois.  Consideration shall be a nominal fee of $10.00.

It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said easement agreement on behalf of the District after it is approved by the Acting General Counsel as to form and legality.

Requested, Susan T. Morakalis, Acting General Counsel, STM:CMM:NPE:vp

Recommended, David St. Pierre, Executive Director

Respectfully Submitted, David J. Walsh, Chairman Committee on Real Estate Development
