Authority to commence statutory procedures to lease 0.074 acres of District real estate located at the northwest corner of Route 83 and 127th Street in Alsip, Illinois; Cal-Sag Channel Parcel 11.03 (Portion)

Dear Sir:

 

SMK3 LLC (“SMK3”) has requested to lease 0.074 acres of District real estate located near the intersection of Route 83 and 127th Street in Alsip, Illinois and known as a part of Cal-Sag Channel Parcel 11.03.  SMK3 owns an adjacent restaurant establishment, and would use the subject site as a driveway in conjunction with the restaurant’s operations. The requested lease term is 50 years.

 

Parcel 11.03 is currently under lease to the Alsip Park District (“Alsip”) for public recreational use and for the construction, operation and maintenance of the Cal-Sag Trail, a bicycle/pedestrian path.  The lease commenced November 1, 1993, and expires October 31, 2052, and comprises 79.931 acres of District real estate known as Cal-Sag Channel Parcels 11.02, 11.03, 12.01, 12.03, 12.11, and part of Parcel 10.03. A companion transmittal letter is on today’s agenda seeking approval to amend Alsip’s lease to allow for the partial surrender of Parcel 11.03 totaling 0.074 acres.  A private lease on this portion of Parcel 11.03 will not affect the construction or operation of the Cal-Sag Trail.

 

The District’s technical departments have reviewed this lease request and have indicated that the subject site is not currently needed for corporate use and that they have no technical objections thereto.    

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Acting General Counsel to commence statutory procedures to lease 0.074 acres of District real estate located at the northwest corner of Route 83 and 127th Street in Alsip, Illinois; Cal-Sag Channel Parcel 11.03 (portion) upon the terms and conditions set forth herein.
