TRANSMITTAL LETTER FOR BOARD MEETING OF OCTOBER 19, 2017

COMMITTEE ON REAL ESTATE

Mr. David St. Pierre, Executive Director

Title

Authority to enter into a Utility Relocation Agreement with the South Stickney Sanitary District to relocate an existing water main on parcels of real estate recently acquired by the District as part of the Melvina Ditch Reservoir Improvements Project (Contract 14-263-3F) located north of 87th Street and west of Natchez Avenue in Burbank, Illinois.  Consideration shall be a nominal fee of $10.00

Body

Dear Sir:

The District has requested that the South Stickney Sanitary District (“SSSD”) enter into a Utility Relocation Agreement (“URA”) with the District that would provide for the relocation of a certain existing water main of SSSD.  The water main is located on parcels of real estate recently acquired by the District as part of the District’s Melvina Ditch Reservoir Improvements Project (“Project”), which will expand the Melvina Ditch Reservoir (“Reservoir”) (Contract 14-263-3F).  The parcels are located north of 87th Street and west of Natchez Avenue in Burbank, Illinois.

The existing SSSD water main provided service to the residential area adjacent to the Reservoir.  Due to its proximity to the expanded Reservoir, it has to be relocated so that the surrounding area can continue to receive such service.

Under the URA, the District’s contractor will remove the existing water main and replace it with a new water main at the northern boundary of the Reservoir area as part of the Project construction.  The relocated easement area is approximately the same size and scope of SSSD’s existing easement area and comprises approximately 7,026 square feet.  The Engineering Department has confirmed that such relocation is consistent with the District’s plans for the construction, operation, and maintenance of the expanded Reservoir, and that the relocation work was included in the contract documents and specifications prepared for the Project.

A nominal fee of $10.00 is recommended as is customary for governmental entities using District property for a public purpose.  In addition, under the URA, SSSD will relinquish any existing easement rights it has on these parcels.

It is requested that the Executive Director recommend to the Board of Commissioners that it grant authority to enter into a Utility Relocation Agreement with the South Stickney Sanitary District to relocate an existing water main on parcels of real estate recently acquired by the District as part of the Melvina Ditch Reservoir Improvements Project (Contract 14-263-3F) located north of 87th Street and west of Natchez Avenue in Burbank, Illinois.  Consideration shall be a nominal fee of $10.00.

It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute the Utility Relocation Agreement on behalf of the District after it is approved by the General Counsel as to form and legality.

Requested, Susan T. Morakalis, General Counsel, STM:CMM:BJD:vp

Recommended, David St. Pierre, Executive Director

Respectfully Submitted, David J. Walsh, Chairman Committee on Real Estate Development
