TRANSMITTAL LETTER FOR BOARD MEETING OF APRIL 2, 2009

COMMITTEE ON JUDICIARY

Mr. Richard Lanyon, Executive Director

Title

Authority to settle the Workers’ Compensation Claim of Jesse Land vs. MWRDGC, Claim No. 0200003195, Illinois Workers’ Compensation Commission in the sum of $75,524.74.  Account 901-30000-601090

Body

Dear Sir:

Jesse Land is an Electrical Mechanic at the Calumet Water Reclamation Plant.  On September 7, 2006 he was walking across a grating/platform twelve feet above ground when the grating collapsed under him.  He fell on the concrete floor and the gratings fell on top of him.  He was taken to St. Francis Hospital and was diagnosed with a right displaced medial malleolar ankle fracture and a left arm strain.

Land underwent two surgeries to his right ankle that included an open reduction and internal fixation of the medial malleolus and a second revision surgery due to non-healing of the fracture.  MRI of his left shoulder revealed a left superior labrum and posterior tear and he underwent arthroscopic repair.  Land had extensive therapy and returned to restricted duty on April 5, 2008.  He lost 417 days of work.

Subject to the approval of the Illinois Workers’ Compensation Commission, this claim can be settled for the sum of $75,524.74, which represents a 30% loss of the use of the left arm and a 27-1/2 % loss of the right foot.

The General Counsel requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.

Requested, Frederick M. Feldman, General Counsel, FMF:LAG:VMM:lrr

Respectfully Submitted, Terrence J. O’Brien, Chairman Committee on Judiciary
