Authority to grant a 25-year, 120,000± sq. ft. non-exclusive easement to the Village of Schaumburg to continue to construct, reconstruct, operate, maintain, repair, replace and remove a 12” sanitary sewer line known as the Briar Pointe sanitary sewer line on District real estate located within the Hanover Park Water Reclamation Plant premises in Hanover Park, Illinois.  Consideration shall be a nominal fee of $10.00

Dear Sir:

 

On August 12, 1993, the Board of Commissioners granted a 25-year, non-exclusive easement to the Village of Schaumburg (“Schaumburg”) to construct, reconstruct, operate, maintain, repair, replace and remove the subject 12” sanitary sewer line known as the Briar Pointe sanitary sewer line.  The Briar Pointe sanitary sewer line traverses the District’s Hanover Park Water Reclamation Plant premises.  The subject easement expires August 11, 2018. 

 

Schaumburg has requested a new 25-year easement to continue to operate and maintain the sewer line.  A portion of the easement traverses the Village of Hanover Park leasehold for public and recreational use which commenced January 1, 2013, and expires December 31, 2052.  Accordingly, the easement is subject to the Village of Hanover Park’s consent.

 

The District’s technical departments have reviewed Schaumburg’s request for continued use of the easement and have no objections thereto.  The District has requested to connect its own sanitary sewer to the Briar Pointe sanitary sewer line, and Schaumburg has no objection to this request.  A nominal fee of $10.00 is recommended as is customary for governmental entities using District property for a public purpose.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it grant a 25-year, 120,000± sq. ft. non-exclusive easement to the Village of Schaumburg to continue to construct, reconstruct, operate, maintain, repair, replace and remove a 12” sanitary sewer line known as the Briar Pointe sanitary sewer line on District real estate located within the Hanover Park Water Reclamation Plant premises in Hanover Park, Illinois.  Consideration shall be a nominal fee of $10.00.

 

It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said easement agreement on behalf of the District after it is approved by the General Counsel as to form and legality.
