Title

Authority to issue a 5-month permit extension retroactive to January 1, 2009, and expiring May 31, 2009, to J.C. Moore II, for occupancy of residential and related buildings located on approximately 1.3 acres of District land formerly known as the Lowell Wier Farm in Fulton County, Illinois, Consideration shall be a monthly permit fee of $175.00

Body

Dear Sir:

On October 30, 1970, the District’s Board of Commissioners approved and authorized the purchase of approximately 5,400 acres of land with improvements from Lowell A. Wier and Lois Wier, his wife, in Fulton County, Illinois.

J. C. Moore II, a District retiree, has occupied approximately 1.3 acres of District land in Fulton County since December 1, 1980.  The land includes a residential building, a barn, and a garage.  The building contains approximately 1,752 square feet and is a non-insulated frame and aluminum construction on a concrete foundation.  It is a 2-story building with a 1-story addition.

Mr. Moore pays a permit fee of $175.00 per month, maintains the property, and makes all necessary repairs to the building, fixtures, and appurtenances, and pays all costs relating to heating, light, and water and sewerage disposal.  Mr. Moore has requested that his permit to occupy the property be renewed for an additional 5 months under the same terms and conditions as the prior permit.  Mr. Moore has indicated that he will be vacating the permit premises by May 31 2009, and will not seek any further renewals.

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the issuance of a 5-month permit extension retroactive to January 1, 2009, and expiring May 31, 2009, to J.C. Moore II for occupancy of residential and related buildings located on approximately 1.3 acres of District land formerly known as the Lowell Wier Farm in Fulton County, Illinois, for consideration of a monthly permit fee of $175.00.

It is further requested that the Executive Director recommend to the Board of Commissioners that it authorize the Chairman of the Committee on Finance and the Clerk to execute said permit extension agreement once approved by the General Counsel as to form and legality.

Requested, Frederick M. Feldman, General Counsel, FMF:CL:JCC:nm

Recommended, Richard Lanyon, Executive Director

Respectfully Submitted, Terrence J. O’Brien, Chairman Committee on Real Estate Development
