Title

Authority to settle the Workers’ Compensation Claim of Esther Billich vs. MWRDGC, Claim 15 WC 03385, Illinois Workers’ Compensation Commission (IWCC), in the sum of $42,596.29, Account 901-30000-601090

Body

Dear Sir:

Esther Billich was a Maintenance Laborer A Shift employee at the Stickney Water Reclamation Plant. She has since retired effective April 30, 2017.  On January 5, 2015, she sustained injuries to her left knee and left ankle.  Ms. Billich was initially seen in the industrial clinic on January 5, 2015.  She was disabled from work effective January 6, 2015.  She returned to work initially on January 17, 2015.  She initially underwent conservative treatment consisting of physical therapy and medication.  She was disabled again effective January 22, 2015 before returning to work on March 13, 2015.  On May 26, 2015 the employee underwent a procedure to repair her left leg.  She was disabled from work again at this time. Following this surgery the employee underwent additional physical therapy.  Ms. Billich was able to return to work on July 22, 2015 to partial work days. She resumed an eight hour work day on October 26, 2015.

Ms. Billich was paid a total of $21,922.93 representing 22.70 weeks of lost time benefits.

Ms. Billich filed an Application of Adjustment of Claim with the Illinois Workers’ Compensation Commission (IWCC) through her counsel.  Subject to the approval of the IWCC, this case can now be settled for $42,596.29, representing approximately 25% loss of use of the left leg and 2.5% loss of use of the left foot.  This settlement will close out future lost time benefits, as well as any future medical benefits associated with this injury.

The Director of Human Resources believes this settlement is in the best interest of the District and requests payment of that sum be approved and she be authorized to execute such documents as may be necessary to effect the settlement.

Requested, Beverly K. Sanders, Director of Human Resources, BKS:RAJ:RG

Respectfully Submitted, Mariyana T. Spyropoulos, Chairman Committee on Judiciary
