Dear Sir:

 

On November 19, 2015 the Board of Commissioners authorized the District to negotiate an Intergovernmental Agreement (IGA) with the Village of Berkeley (Village) for the McDermott Drive and Morris Avenue storm sewer improvements under Phase II of the Stormwater Management Program.

 

The proposed improvements, which will provide flood control benefits to 800 structures, include the construction of two new storm sewers along McDermott Drive and Morris Avenue, expansion of an existing detention basin, and construction of a new stormwater pumping facility.

 

On June 2, 2016 the Board of Commissioners authorized the District to enter into this IGA and make payment to the Village in an amount not to exceed $2,696,000.00. The Village planned to construct the project in two phases, with the first being completed in 2016 through storm sewer work coordinated with local roadway improvements funded through a State transportation program.  The second phase was bid out by the Village on March 28, 2018, and since the resulting bids were significantly higher than expected, they were rejected and the Village proceeded to split the improvements into two separate contracts, one for the sewer work and the other for excavation and pump station work. The Village has also coordinated with interstate highway infrastructure improvements in the vicinity to utilize clean spoil materials generated from the Village’s project to provide an opportunity for cost savings.  However, in order to ensure the necessary funding is available for construction, the Village has requested that the District increase its maximum contribution by $957,622.00 in addition to the original amount of $2,696,000.00.  To date the Village has expended $400,800.00 towards preliminary engineering and design, and is committed to spending another $455,000.00 for construction management costs.  Cook County, through its Community Development Block Grant-Disaster Recovery program has offered to contribute $957,622.00 in additional dollars, effectively splitting the additional funding the Village needs with the District. Increasing the District contribution of this project to an amount not exceed $3,653,622.00 will ensure these valuable flood control improvements are constructed.

 

It is respectfully requested that the Board of Commissioners grant authority to amend this IGA and that the Chairman of the Committee on Finance, Executive Director, and Clerk be authorized to execute said amendments on behalf of the District upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.

 

Funds for the 2018 expenditures, in the amount of $2,696,000.00, are available in Account 501-50000-612400. Funds for the 2019 expenditure in the amount of $957,622.00, will be contingent on the Board of Commissioners’ approval of the District’s budget for 2019.
