Dear Sir:

 

On July 28, 1999, the Metropolitan Water Reclamation District (District) issued to the Village of La Grange (Village) a sewerage system permit as part of the Tilden Avenue Improvements Project, located along Tilden Avenue and Shawmut Avenues from Cossitt Avenue to East Avenue, La Grange, Illinois. In connection with that activity, Junction Chamber No. 1 (Structure), a 13-foot by 13.25-foot by 12-foot deep concrete chamber was constructed and connected to MWRD TARP Construction Shaft No. 5 for a new 24-inch relief sewer serving Tilden Avenue and a future 42-inch sewer stub. The Structure is located near the intersection of Tilden Avenue and the BNSF Railroad. Special Condition No. 1 for Sewerage Permit No. 99-076 requires that ownership of the Structure be conveyed to the District for purposes of maintenance and ownership and to allow other entities to use the structure as applicable. The Village and the District have reached an agreement transferring ownership of the Structure through a Structure Assignment Agreement, pending approval by the District’s Board of Commissioners. Consideration is a nominal fee of ten dollars ($10.00).

 

The Village’s Board of Trustees approved the Structure Assignment Agreement on July 9, 2018.

 

Accordingly, it is respectfully requested that the Acting Executive Director recommend to the Board of Commissioners that it authorize and approve the execution of the Structure Assignment Agreement for Permit No. 99-076, upon the terms and conditions referenced above.

 

It is further respectfully requested that the Acting Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and Clerk be authorized and directed to execute the Structure Assignment Agreement on behalf of the District after it is approved by the Director of Engineering as to technical matters and the General Counsel as to form and legality.
