Dear Sir:

 

Stephen Scannell was an Electrical Mechanic at the Calumet Water Reclamation Plant.  On September 19, 2013, he sustained an injury to his right shoulder.  Mr. Scannell was initially seen by the doctor at the industrial medical clinic on September 19, 2013.  He was initially disabled from work effective September 24, 2013.  His initial treatment consisted of physical therapy and medications.  He returned to work on November 21, 2013.  He was disabled from work again effective December 10, 2013 at which time he underwent a procedure on his right shoulder.  Mr. Scannell returned to work on January 24, 2014.   

 

Mr. Scannell injured his right shoulder again on January 14, 2015.  He was seen at the industrial clinic on January 14, 2015.  He initially was treated with physical therapy and medications, however, his shoulder failed to improve.  The employee was disabled from work effective April 21, 2015 after having undergone a second procedure on his right shoulder.  He underwent a course of physical therapy following the surgery and he returned to work on July 13, 2015.

 

Mr. Scannell retired from the District effective January 29, 2016.  He continued to experience problems with his right shoulder and required a third procedure on his shoulder on July 11, 2016.  It was verified that this third procedure was a result of the January 14, 2015 accident.

 

Mr. Scannell was paid a total of $16,923.08 in lost time benefits for the September 19, 2013 injury for a total of 15 weeks.  He was paid a total of 11.8 weeks in lost time benefits for a total paid of $13,725.56 for the January 14, 2015 injury.   

 

Mr. Scannell filed two Applications of Adjustment of Claims with the Illinois Workers’ Compensation Commission (IWCC) through his counsel.  Subject to the approval of the IWCC, these cases can now be settled for a total of $66,353.13, representing approximately 18.216 % loss of person as a whole. This settlement will close out future lost time benefits, as well as any future medical benefits associated with these injuries.

 

The Director of Human Resources believes this settlement is in the best interest of the District and requests payment of that sum be approved and she be authorized to execute such documents as may be necessary to effect the settlement.
