Request to recognize the authority of the Governor to fill the vacancy of Commissioner Bradford by the appointment made on March 23, 2018

Dear Sir:

 

The District’s enabling statue, 70 ILCS 2605/3, states in part: “when a vacancy exits in the office of trustees of any sanitary district organized under the provisions hereof, the vacancy shall be filled by appointment by the Governor until the next regular election at which trustees of the Sanitary District of Chicago are elected, and thereafter until a successor shall be elected and qualified.”

 

Because of the timing of the vacancy created by Commissioner Bradford’s death, there was insufficient time for any candidate to properly qualify for the next regular election of November, 2018.

 

In accordance with the statute as applied to these facts, the Board of Commissioners hereby recognizes the authority of the Governor to fill the vacancy of Commissioner Timothy Bradford by the appointment made on March 23, 2018 and that such appointment is effective until the General Election of November, 2020, when a successor can be elected and qualified.
