Authority to issue a 3-month permit to BP Pipelines (North America), Inc. to use Cal-Sag Channel Parcel 1.02 for construction staging and Cal-Sag Channel Parcel 1.04 for vehicular access in Lemont, Illinois.  Consideration shall be $5,000.00

Dear Sir:

 

Since 1954, BP Pipelines (North America), Inc. (“BP”) has operated and maintained an approximate 9.4 mile, 8-inch diameter subterranean petroleum pipeline (“Pipeline”) traversing several parcels of District land along the Main Channel and the Cal-Sag Channel in Cook County, Illinois between approximately Harlem Avenue in Forest View, Illinois and Route 83 in Lemont, Illinois under a perpetual easement.  The Pipeline crosses over the Cal-Sag Channel by way of the Route 83 Bridge, which is not owned by the District.

 

BP intends to replace and repair a 35-foot section of the Pipeline along the Bridge.  None of BP’s work on the Pipeline will be performed on District land.  In conjunction with its planned work, BP requests a 3-month permit to use Cal-Sag Channel Parcel 1.02 in Lemont, Illinois for construction staging to park vehicles and store materials and equipment, and Cal-Sag Channel Parcel 1.04 in Lemont for vehicular access to the south end of the Bridge.

 

Parcel 1.02 comprises approximately 1.86 acres and is vacant.  Parcel 1.04 comprises a several-mile stretch of District land leased to the Forest Preserve District of Cook County (“Forest Preserve”) under a lease that commenced April 1, 2006, and expires March 31, 2045, for public recreational use, including maintaining the Cal-Sag Trail.  Any permit will be subject to the written consent of the Forest Preserve.

 

The District’s technical departments have reviewed this request and have no objections thereto.  A permit fee in the amount of $5,000.00 is recommended, as the pro-rata share of 10% of the fair market value of the land would yield a fee less than the District’s minimum permit fee of $5,000.00.

 

It is requested that the Acting Executive Director recommend to the Board of Commissioners that it authorize and approve the issuance 3-month permit to BP Pipelines (North America), Inc. to use Cal-Sag Channel Parcel 1.02 for construction staging and Cal-Sag Channel Parcel 1.04 for vehicular access in Lemont, Illinois.  Consideration shall be $5,000.00.

 

It is also requested that the Acting Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said permit agreement after it is approved by the General Counsel as to form and legality.
