Dear Sir:

 

Since 1954, BP Pipelines (North America), Inc. (“BP”) has operated and maintained an approximate 9.4 mile, 8-inch subterranean petroleum pipeline (“Pipeline”) traversing the southern bank of the Main Channel between Route 83 in Lemont and Harlem Avenue in Forest View, Illinois.  The easement is perpetual and was subject to a one-time payment of $49,510.00.

 

BP is performing in-line maintenance work and has requested a nine (9) month permit to use an approximate 40’ x 80’ portion of Main Channel Parcels 27.01, 28.02, 28.06, 33.04 and 37.05 in Lemont, Willow Springs, Bedford Park, and Forest View, Illinois for construction staging.  At each staging area, BP will store excavated soil and construction and repair equipment, and park motor vehicles.

 

Parcels 33.04 and 37.05 are currently vacant.  Parcel 27.01 is leased to Full Circle Repair (“Full Circle”) until September 30, 2060, Parcel 28.02 is leased to the Cook County Forest Preserve District (“Forest Preserve District”) until March 31, 2033, and Parcel 28.06 is leased to Rowell Chemical Corporation (“Rowell”) until December 31, 2048.  The permit is therefore subject to the written consents of these entities.

 

The District’s technical departments have reviewed this request and have no objections thereto.  A permit fee in the amount of $5,000.00 is recommended, as the pro-rata share of 10% of the fair market value of the land would yield a fee less than the District’s minimum permit fee of $5,000.00.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and approve the issuance of a nine (9) month permit to BP Pipelines (North America), Inc. to use an approximate 40’ x 80’ portion of Main Channel Parcels 27.01, 28.02, 28.06, 33.04 and 37.05 in Lemont, Willow Springs, Bedford Park, and Forest View, Illinois.  Consideration shall be $5,000.00.

 

It is also requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said permit agreement after it is approved by the General Counsel as to form and legality.
