Dear Sir:

 

Authorization is requested to enter into an Intergovernmental Agreement (IGA) with and make payment to the Village of Elk Grove Village (Village) for the design, construction, operation and maintenance of culvert improvements along Louis Avenue under Phase II of the Stormwater Management Program.

 

On May 17, 2018, the Board of Commissioners authorized the District to begin negotiations with several entities, including the Village of Elk Grove Village, for IGAs that would include provisions allowing for the District to provide funding towards the construction of various shovel ready stormwater projects.  The Village’s proposed project consists of 925 feet of box culvert adjacent to Louis Avenue along with upstream drainage way improvements.  Upon completion of these improvements, the project will provide flood reduction benefits to an estimated 30 structures in an industrial business park in the Village.  The District and the Village have agreed in principle to the terms of the IGA, which include payment by the District towards construction costs of the captioned project in an amount not to exceed $1,250,000.00.  Partial payments to the Village will be made at predefined intervals during construction, which is anticipated to commence in 2019.  The Village has spent approximately $85,000.00 on engineering, property acquisition, and other design-related project costs, and will contribute approximately $2,310,000.00 towards total project costs, including design, acquisition, construction and construction inspection.  The IGA will require the Village to advertise and award the construction contract in conformance with the District’s Purchasing Act, Multi-Project Labor Agreement and Affirmative Action Requirements, assume responsibility for design, construction, perpetual maintenance and operation of the project, and be solely responsible for any change orders to the project. The IGA also contains provisions which allow the District to perform inspections after the project is constructed.

 

Based on the foregoing, it is requested that the Board of Commissioners grant authority to enter into an IGA with the Village and make payment to the Village in an amount not to exceed $1,250,000.00.  It is further requested that the Chairman of the Committee on Finance, Executive Director, and Clerk be authorized to execute said agreement on behalf of the District, as well as any documents necessary to effectuate the transaction and conveyance, upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.

 

Funds for the 2019 expenditure, in the amount of $645,800.00, are available in Account 501-50000-612400.  The estimated expenditure for 2020 is $604,200.00.  Funds for the 2020 expenditure are contingent on the Board of Commissioners’ approval of the District’s budget for that year.
