Authority to issue a 3-year permit to the Illinois Department of Natural Resources to periodically access an approximate 1,643 acres of District land located south of IL-5/Hickory Road in unincorporated Fulton County, Illinois for studying Canadian geese.  Consideration shall be a nominal fee of $10.00

Dear Sir:

 

The Illinois Department of Natural Resources (“IDNR”) has requested a 3-year permit for periodic access to an approximate 1,643 acres of District land located south of IL-5/Hickory Road in unincorporated Fulton County, Illinois (“Permit Premises”) to study dispersal, migration and survival rates of Canadian geese.  Under the requested permit, in or around June of each year, IDNR would access the Permit Premises to locate and capture geese, attach identifying leg bands and release the geese on-site.

 

The District’s technical departments have reviewed this request and have no objections thereto.  A nominal fee of $10.00 is recommended as is customary for governmental entities using District property for a public purpose.

 

IDNR has requested a waiver of the environmental contamination insurance requirement and a reduction of the general liability and property damage insurance requirements from $4,000,000.00 to $1,000,000.00.  The Board of Commissioners has previously approved this same request by the Illinois Natural History Survey in its study of Canadian geese, determining that the study of geese poses little or no risk of environmental contamination to District land and that the potential liability to third parties on account of the permittee’s actions is very limited.  The Engineer of Site Remediation has no objection to a grant of a waiver of the environmental contamination insurance requirement in this instance.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and approve the issuance of a 3-year permit to the Illinois Department of Natural Resources to periodically access an approximate 1,643 acres of District land located south of IL-5/Hickory Road in unincorporated Fulton County, Illinois for studying Canadian geese.  Consideration shall be a nominal fee of $10.00.

 

It is also requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said permit agreement after it is approved by the General Counsel as to form and legality.
