Dear Sir:
Authority is requested to negotiate and enter into an agreement with the Village of Chicago Ridge for the resurfacing of 99th Street from Ridgeland Avenue to Nashville Avenue associated with the captioned project.
At the August 29, 2013, Board Meeting, the Board of Commissioners granted its approval to enter into an agreement with the Village of Chicago Ridge and the Village of Oak Lawn outlining various responsibilities associated with the proposed streambank stabilization improvements on Melvina Ditch. The District entered into an Intergovernmental Agreement (IGA) with the aforementioned villages, dated October 7, 2016, for the construction and perpetual maintenance of the streambank stabilization project on Melvina Ditch.
Following the District’s response to the 98% review comments submitted by the Village of Chicago Ridge, in accordance with the executed IGA, the Village of Chicago Ridge requested that the District include, in the construction project scope, the resurfacing of 99th Street, curb to curb, from Ridgeland Avenue to Nashville Avenue, due to concerns around the impact that project related truck traffic will have on the lifespan of the existing asphalt pavement. Project related truck traffic is only able to enter the project site through 99th Street, and therefore, the project cannot be accomplished without traversing over the 99th Street asphalt pavement. The Village of Chicago Ridge offered to cost share on a portion of the resurfacing work, subject to the scope and limits of the resurfacing work. The new agreement with the Village of Chicago Ridge will outline the scope of work and determine the portion of the total costs to resurface 99th Street that the Village of Chicago Ridge will have to reimburse to the District. In addition, under the new agreement, the District only intends to cover those resurfacing costs associated with pavement areas on 99th Street impacted by project related truck traffic.
As a condition of the new agreement, funds would be paid to the District by the Village of Chicago Ridge after the District’s contractor submits a payment request that includes the associated asphalt pavement resurfacing work. Utilizing the joint efforts and resources of the District and the Village of Chicago Ridge allows for a more effective, economical, and comprehensive approach to ensuring a successful project, and accordingly, this arrangement is in the best interest of the District. The agreement shall be subject to the approval of the Law Department as to form and legality.
It is respectfully requested that the Board of Commissioners grant authority for the District to negotiate and enter into an agreement with the Village of Chicago Ridge for their request to cost share on the resurfacing of 99th Street. It is also requested that the Chairman of the Committee on Finance and Clerk be authorized and directed to execute the agreement on behalf of the District, as well as any documents necessary to effectuate the transaction and conveyance, upon approval by the Director of Engineering as to technical matters and by the General Counsel as to form and legality.
