Authority to amend easement agreement dated January 5, 2012, as amended, between the District and Commonwealth Edison Company on approximately 20.50 acres of District real estate located south of 135th Street in Romeoville, Will County, Illinois, commonly known as Main Channel Parcel 18.03, to add 0.518 acres located on Main Channel Parcels 18.01 and 18.02 to the existing easement premises.  Consideration shall be a document preparation fee of $5,000.00

Dear Sir:

 

Commonwealth Edison Company (“ComEd”) operates an electrical substation and electrical transmission lines on approximately 20.50 acres of District real estate located south of 135th Street in Romeoville, Will County, commonly known as Main Channel Parcel 18.03 under an easement that commenced in 2012 and expires December 31, 2036. ComEd’s current annual easement fee is $74,278.69.

 

ComEd is planning to relocate its electrical transmission lines at this location to vacate land inhabited by the Emerald Dragonfly, an endangered species under the Endangered Species Act of 1973.  To relocate these lines, ComEd’s current easement must be amended to add a total of 0.518 acres in two areas for new electrical poles.  The first area is 0.499 acres and is located on Main Channel Parcel 18.01.  The second area is .019 acres and is located on Main Channel Parcel 18.02.  Main Channel Parcels 18.01 and 18.02 are currently vacant.

 

The District's technical departments have reviewed ComEd’s request and have no objections thereto.

 

An increase of $1,878.99 to ComEd’s current annual easement fee of $74,278.69 for a total of $76,157.68 is recommended for the additional easement area.  This increase represents the pro-rata share of ComEd’s current annual easement fee. 

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize an amendment of the easement agreement dated January 5, 2012, as amended, between the District and Commonwealth Edison Company on approximately 20.50 acres of District real estate located south of 135th Street in Romeoville, Will County, Illinois, commonly known as Main Channel Parcel 18.03 to add 0.518 acres located on Main Channel Parcels18.01 and 18.02 to the existing easement premises. Consideration shall be a document preparation fee of $5,000.00.

 

It is also requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said easement amendment after it is approved by the General Counsel as to form and legality.
