Dear Sir:
 
The CITGO Lemont Refinery Fire Department ("CITGO") has requested a permit to use the access road and boat ramp on Main Channel Parcel 15.05 ("MCP 15.05") to launch and retrieve a spill response boat from the Main Channel.  CITGO operates an oil refinery north of 135th Street in Lemont, Illinois.  CITGO is requesting use of the boat launch because of its limited access to the canal if an emergency response is required in the event of an oil spill as a result of its refinery operations.
 
Since 2009, the District's Board of Commissioners has authorized the use of MCP 15.05 by several governmental agencies and a private entity to launch boats into the Main Channel for emergency response purposes and to enable some agencies to conduct fish population surveys, collect fish species, and to determine the effectiveness of the electronic nuisance barriers located north of 135th Street and operated by the Corps of Engineers.
 
The District's technical departments have reviewed this request and have no objections thereto.  CITGO will be responsible for implementing safety protocols for its boats and their crews and for coordinating with other governmental or private entities issued permits to use the boat launch.  CITGO anticipates use of MCP 15.05 only as needed for emergency response events and posing no interference with other permittees.  As the anticipated use of the parcel would have little impact on the overall use of the site and encompasses only a small area, a fair market value fee would yield less than the District's minimum $2,500.00 fee.  It is therefore recommended that the District's minimum annual fee of $2,500.00 be assessed.
 
It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the issuance of a 5-year permit to the CITGO Lemont Refinery Fire Department to use the boat launch and an access road thereto on Main Channel Parcel 15.05 in Lockport, Will County, Illinois, to launch and retrieve a spill response boat from the Main Channel.  Consideration shall be an annual fee of $2,500.00.
 
It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize the Chairman of the Committee on Finance and the Clerk to execute said permit agreement once approved by the General Counsel as to form and legality.
