Body

Dear Sir:

On September 8, 1988, the District's Board of Commissioners granted to the City of Chicago ("City") an easement to operate a storm sewer outfall pipe on District real estate located along the east bank of the North Branch of the Chicago River, north of Bradley Place and west of Rockwell Avenue in Chicago.  The easement commenced December 19, 1989 and it is set to expire September 7, 2013. The City has requested a new 25-year easement upon expiration of the current easement.

The District's technical departments have reviewed the subject request and have no objections thereto.

An easement fee of $10.00 is recommended as is customary for governmental entities operating storm sewer outfall pipes for public purposes.

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the grant of a 25-year, 20' x 35' non-exclusive easement to the City of Chicago to continue to maintain, operate, repair, remove and reconstruct an 18-inch storm sewer outfall pipe on District real estate located along the east bank of the North Branch of the Chicago River, north of Bradley Place and west of Rockwell Avenue in Chicago, Illinois. Consideration shall be a nominal fee of $10.00.

It is also requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the Chairman of the Committee on Finance and the Clerk to execute said easement agreement on behalf of the District after it is approved by the General Counsel as to form and legality.

Requested, Ronald M. Hill, General Counsel, RMH:STM:MM
Recommended, David St. Pierre, Executive Director
Respectfully Submitted, Mariyana T. Spyropoulos, Chairman Committee on Real Estate Development
