Mr. David St. Pierre, Executive Director

Title
Authority to settle the Workers' Compensation Claim of James Aldworth vs. MWRDGC, Case No. 12 WC 37912, Illinois Workers' Compensation Commission (IWCC), in the sum of $55,061.15.  Account 901-30000-601090
Body

Dear Sir:

James Aldworth is an Ironworker who works at the Stickney Water Reclamation Plant.  On February 3, 2011, he injured his right shoulder at work.  On February 14, 2011, an MRI of the right shoulder indicated full thickness tears of the supraspinatus and infraspinatus tendon with retraction, partial tears in the subscapularis and teres minor tendons, bicep and labrum tendons.  On May 5, 2011, he underwent a right shoulder arthroscopy that included extensive debridement, subacromial decompression, and clavicle resection.  Mr. Aldworth underwent a course of physical therapy post-surgery and was able to return to work on November 2, 2011.  He was paid a total of 38 weeks of lost time benefits for this injury.

Mr. Aldworth filed an Application for Adjustment of Claim with the IWCC through his counsel.  Subject to approval of the IWCC, this claim can now be settled for the sum of $55,061.15, which represents 16.44% loss of use of the body as a whole.  This settlement will close out any future lost time benefits as well as any future medical exposure on this claim.

The General Counsel believes this settlement is in the best interest of the District and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.

Requested, Ronald M. Hill, General Counsel, RMH:LAG:RG:nm
Respectfully Submitted, Mariyana T. Spyropoulos, Chairman Committee on Judiciary
