Dear Sir:
 
On April 5, 2012, the Board of Commissioners ("Board") authorized the issuance of a 39-year lease to the Mount Prospect Park District ("MPPD") for the continued use of the subject District real estate located east of Elmhurst Road and south of the James C. Kirie Water Reclamation Plant in Des Plaines, Illinois, and known as Majewski Metro Park for public recreational purposes ("Lease").  
 
The Lease allows the MPPD to use the leasehold for public recreational purposes including the permitted use of selling alcoholic beverages five (5) times a year, subject to the MPPD furnishing dram shop liability insurance coverage and indemnifying the District from all liabilities associated therewith.  Illinois Statute 235 ILCS 5/6-15 allows for the sale and consumption of alcohol on District-owned real estate when leased for a term of at least 20-years and such use is specifically approved by the Board.
 
To accommodate its burgeoning softball and soccer tournaments schedule, MPPD has requested an amendment to the Lease allowing it to sell alcoholic beverages eight (8) times a year, subject to it furnishing dram shop liability insurance coverage and indemnifying the District from all liabilities associated therewith.
 
It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and approve an amendment of the lease agreement dated April 5, 2012, between the District and the Mount Prospect Park District on 34.239 acres located east of Elmhurst Road and south of the James C. Kirie Water Reclamation Plant in Des Plaines, Illinois, and known as Majewski Metro Park for public recreational purposes, to increase the permitted use of selling alcoholic beverages on the leasehold from five (5) to eight (8) times a year.  Consideration shall be a nominal fee of $10.00.
 
It is also requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said amendment after it is approved by the General Counsel as to form and legality.
