Dear Sir:
 
Frederick Smolinski was an Electrical Mechanic at the Calumet Water Reclamation Plant.  On November 22, 2005, he injured his right shoulder/neck area at work.  On May 4, 2006, he underwent a right shoulder subacromial decompression, debridement of torn labrum, and repair of rotator cuff.  On March 25, 2008, he underwent a cervical posterior spinal fusion from the level C3-T2.
 
Mr. Smolinski's permanent, post-operative work restrictions could not be accommodated, and efforts to find him alternative work under the Illinois Workers' Compensation Act (Act) proved unsuccessful.
 
Mr. Smolinski has been paid a total of 107 weeks of lost time benefits and continues to receive lost time benefits at the rate of $48,360.78 per year.
 
Subject to approval of the IWCC, this pro se claim can now be settled for the lump sum of $220,000.00 representing a compromised wage differential pursuant to the Act.  This settlement will close out any future lost time benefits on this claim.
 
The General Counsel believes this settlement is in the best interest of the District and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.
