Authority to enter into an intergovernmental agreement with the City of Northlake concerning Project ADCR-7B from the Detailed Watershed Plan for the Lower Des Plaines River Watershed

Dear Sir:
Authorization is requested to enter into an Intergovernmental Agreement (IGA) with the City of Northlake (City) concerning Project ADCR-7B from the Detailed Watershed Plan for the Lower Des Plaines River Watershed.
On February 21, 2013, the Board of Commissioners authorized the District to begin negotiations with the City for an IGA that would include provisions allowing for the District to provide funding towards the construction of Project ADCR-7B. Please see attached exhibit. Since then, the District and City have agreed in principle as to the terms of the IGA. The IGA requires the District to fund the project up to $1,000,000.00. The IGA requires the City to award the construction contract in conformance with the District's Purchasing Act, assume responsibility for perpetual maintenance and operation, design the project, and provide construction oversight of the project. The IGA also contains provisions which allow District oversight of the project's design and construction.
Based on the foregoing, the Engineering Department recommends that the District be authorized to enter into an IGA with the City for collaboration of Project ADCR-7B from the Detailed Watershed Plan for the Lower Des Plaines River Watershed and that the Chairman of the Committee on Finance, the Executive Director and the Clerk be authorized to execute said IGA on behalf of the District, upon approval by the Directors of Engineering, Maintenance and Operations and Monitoring & Research as to technical matters and by the General Counsel as to form and legality.
