Owens Corning Roofing & Asphalt LLC ("Owens Corning") and its predecessors have occupied 5.29± acres of District real estate known as Main Channel Parcels 34.02 and 34.09 under successive leases and permits since May 1, 1946.  Parcel 34.02 comprises 4.6± acres located along the Main Channel and Parcel 34.09 comprises 0.715± acres which is an isolated parcel located across from and east of the Illinois & Michigan Canal right-of-way and the Illinois Central railroad tracks.
 
Both parcels are used in conjunction with the existing operations of Owens Corning's own asphalt plant located directly adjacent to Parcel 34.09.  Because the 4.6± acre parcel and the 0.715± acre parcel are not adjacent to each other and to allow time to complete an additional environmental assessment on the 0.715± acre parcel, two separate leases were recommended at the time the lease on both parcels expired in 2011.  The Board of Commissioners awarded a long-term lease to Owens Corning for Parcel 34.02 on December 6, 2012. Owens Corning continues to occupy Parcel 34.09 under a permit that expires November 14, 2013.  The permit fee is $5,734.00.  Owens Corning has requested a 39-year lease on Parcel 34.09.
 
Parcel 34.09 is improved with four above ground storage tanks containing mineral spirits, a rail spur and fencing.  The additional environmental site investigations performed on Parcel 34.09 are now complete and they did not identify any environmental impairments attributable to Owens Corning's operations at the site.
 
The District's technical departments have reviewed Owens Corning's request to lease Parcel 34.09 and have indicated there are no objections to making this site available for a 39-year lease.
 
It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and direct the General Counsel to commence statutory procedures to lease 0.715± acres of improved District real estate located near 7800 West 59th Street in Summit, Illinois; Main Channel Parcel 34.09 upon the terms and conditions set forth herein.
