Dear Sir:
 
On September 4, 1986, the Board of Commissioners ("Board") authorized the grant of a 25-year easement to Midwest Sybron Corporation ("Midwest") to operate the subject water main.  Upon expiration of the easement, Midwest requested a new 25-year easement to continue to operate and maintain the water main.  Because current District policy is to grant water main easements to municipalities rather than to private entities, the City of Des Plaines ("Des Plaines") was requested to be the easement grantee under any new easement grant for the subject water main.
 
Thereafter, on September 15, 2011, the Board authorized the issuance of a 6-month permit to Midwest to allow it to continue to use the subject property for the same permitted use as was allowed under its easement until a decision was reached by Des Plaines as to whether it would agree to be the grantee under a new easement for the subject water main.  Subsequently, Space Center Air Cargo, Inc. ("Space Center") became the owner of the land upon which the permit benefits. Upon expiration of Midwest's permit, Space Center was then issued a 6-month permit to allow it to continue to use the subject property until a decision was reached by Des Plaines.  Space Center's permit expires January 14, 2013.  Des Plaines has indicated that it is now ready to proceed with becoming the easement grantee.
 
The District's technical departments have no objection to granting this easement.  A nominal fee of $10.00 is recommended as Des Plaines is a municipal agency operating the water main for a public purpose.
 
It is requested that the Executive Director recommend to the Board of Commissioners that it authorize and approve the grant of a 25-year, 930' x 10' non-exclusive easement to the City of Des Plaines for the operation, maintenance, and removal of a 10-inch diameter water main within the District's James C. Kirie Water Reclamation Plant premises.  Consideration shall be $10.00.
 
It is further requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said easement agreement after it is approved by the General Counsel as to form and legality.
