Dear Sir:
Authorization is requested to enter into an Intergovernmental Agreement (IGA) with the Village of Elmwood Park (Village) concerning Project GCTR-1 from the Detailed Watershed Plan for the Lower Des Plaines River Watershed, with payment to the Village not to exceed $5,170,087.00.
On April 5, 2012, the Board of Commissioners authorized the District to begin negotiations with the Village for an IGA that would include provisions allowing for the District to provide funding towards the construction of Project GCTR-1. Please see the attached exhibit. Since then, the District and Village have agreed in principle as to the terms of the IGA. The IGA requires the District to fund the project up to $5,170,087.00 with payment occurring at various interludes of construction, which is anticipated to occur in 2014. The IGA requires the Village to award the construction contract in conformance with the District's Purchasing Act, assume responsibility for perpetual maintenance and operation, design the project, and provide construction oversight of the project. The IGA also contains provisions which allow District oversight of the project's design and construction.
Based on the foregoing, the Engineering Department recommends that the District be authorized to enter into an IGA with the Village and make payment to the Village up to $5,170,087.00 for construction of Project GCTR-1 from the Detailed Watershed Plan for the Lower Des Plaines River Watershed and that the Chairman of the Committee on Finance, the Executive Director and the Clerk be authorized to execute said IGA on behalf of the District, upon approval by the Directors of Engineering, Maintenance and Operations and Monitoring & Research as to technical matters and by the General Counsel as to form and legality.
Funds for this expenditure will be contingent on the Board of Commissioners' approval of the District's budget for 2014.
