Title

Authority to grant a 39-year lease to the Village of Palos Park on District’s property located at Cal-Sag Road and 86th Avenue in Palos Park, Illinois, and known as Cal-Sag Index Parcel 7.02, in connection with a proposed bicycle/pedestrian trail along the Cal-Sag Channel known as “Calumet-Sag Trail.”  Consideration is a nominal fee of $10.00

Dear Sir:

 

At its February 3, 2005 meeting, the District’s Board of Commissioners authorized the issuance of a 5-year permit to the Village of Palos Park (“Village”) to use approximately 12.8 acres of District property located at Cal-Sag Road and 86th Avenue in Palos Park, Illinois, and known as Cal-Sag Index Parcel 7.02, to develop a walking or bicycle path along the water’s edge and to keep the remainder of the site as open space.  The subject permit is set to expire on February 28, 2010.  During this period, the Village reported it has actively pursued preliminary matters in connection with the proposed construction, financing, design and Phase I and Phase II environmental assessment of the site.  Attached is a drawing depicting the permit area.

 

The Village now requests that, upon the expiration of the subject permit, the Village be allowed to continue to use the subject site to develop a walking or bicycle path along the water’s edge under the terms and conditions of a 39-year lease.  The subject bicycle/pedestrian path will be part of a proposed 26 miles in length trail called “Calumet-Sag Trail” which will be constructed in cooperation with other municipalities and government agencies and will connect with the Centennial Trail on the west and the Burnham Greenway Trail on the east.

 

The Village’s use of the subject District land would be subject to all the District’s standard lease requirements, including insurance coverage and the duty to maintain the land.  The District’s technical departments have no objections to the grant of the lease.

 

Accordingly, it is requested that the Executive Director recommend to the Board of Commissioners that it authorize and approve the grant of a 39-year lease to the Village of Palos Park on District’s property located at Cal-Sag Road and 86th Avenue in Palos Park, Illinois, and known as Cal-Sag Index Parcel 7.02, in connection with a proposed bicycle/pedestrian trail along the Cal-Sag Channel known as “Calumet-Sag Trail.”  Consideration is a nominal fee of $10.00.

 

It is further requested that the Executive Director recommend to the Board of Commissioners that the Chairman of the Committee on Finance and the Clerk be authorized and directed to execute said lease agreement after same is approved by the General Counsel as to form and legality.
