Dear Sir:

 

Authority is requested to commence statutory procedures for a 39-year lease on approximately 37.25 acres of District land lying at the confluence of the Cal-Sag and Main Channels in Lemont, Illinois, and c/k/a Main Channel Parcel Numbers 26.02 and 26.03.

 

The sites are currently occupied by IMTT-Lemont n/k/a IMTT-Illinois (“IMTT”) under permit.  IMTT uses the sites to operate a portion of its bulk chemical and petroleum product storage and distribution facility.  IMTT previously occupied the sites under a lease and upon expiration of the lease was allowed to continue to operate under a series of permits pending resolution of certain environmental issues and completion of statutory procedures for a new lease.

 

The environmental issues have been addressed to the satisfaction of the Engineer of Site Remediation.  IMTT has remediated the “hotspots” and submitted short-term and long-term remediation plans.  Implementation of remediation plans will depend upon the outcome of the bidding for a new lease.  If IMTT is awarded a new lease, it will be a condition of the lease that IMTT implement the long-term remediation plan during the course of the new lease.  If IMTT is not the successful bidder, it will be required to immediately implement the short-term remediation plan.

 

The technical departments have no objections to the property being made available for a 39-year lease.

 

It is requested that the Executive Director recommend to the Board of Commissioners that it authorize the commencement of statutory procedures of a 39-year lease on approximately 37.25 acres of District land lying at the confluence of the Cal-Sag and Main Channels in Lemont, Illinois, and c/k/a Main Channel Parcel Numbers 26.02 and 26.03, upon the terms and conditions set forth above.
