TRANSMITTAL LETTER FOR BOARD MEETING OF FEBRUARY 4, 2010

COMMITTEE ON PROCUREMENT

Mr. Richard Lanyon, Executive Director

Title

Authority to decrease purchase order and amend agreement with Greene & Letts for legal services in the amount of $3,684.50 from an amount of $40,000.00 to an amount not to exceed $36,315.50, Account 101-30000-601170, Purchase Order 3035481.

Body

Dear Sir:

On August 11, 2005, the Board of Commissioners authorized the Director of Procurement and Materials Management to issue a purchase order and enter into an agreement for legal services in connection with the case of Svoboda, et al v. MWRD, et al., No. 04 C 12018 with the law firm of Greene & Letts in an amount not to exceed $40,000.00.

The decrease in the contract value is being requested because this matter has been successfully resolved.  The services of the law firm of Green & Letts are no longer required.

This change order is in compliance with the Illinois Criminal Code since the change is due to circumstances not reasonably foreseeable at the time the contract was signed, and is in the best interest of the District.

It is hereby recommended that the Board of Commissioners authorize the Director of Procurement and Materials Management to execute a change order to decrease the purchase order and amend the agreement in an amount of 3,684.50 (9.2% of the current contract value) from an amount of $40,000.00, to an amount not to exceed $36,315.50.

Funds will be restored in Account 101-30000-601170.

Requested, Frederick M. Feldman, General Counsel, FMF:LJH:crb

Recommended, Darlene A. LoCascio, Director of Procurement and Materials Management

Respectfully Submitted, Barbara J. McGowan, Chairman Committee on Procurement
