TRANSMITTAL LETTER FOR BOARD MEETING OF FEBRUARY 18, 2010

COMMITTEE ON JUDICIARY

Mr. Richard Lanyon, Executive Director

Title

Authority to settle the Workers’ Compensation Claim of Esther Billich vs. MWRDGC, Case No. 09 WC 16063, Illinois Workers’ Compensation Commission, in the sum of $27,752.06, Account 901-30000-601090

Body

Dear Sir:

Esther Billich is an MLAS at the Stickney Water Reclamation Plant.  On March 11, 2009, while emptying garbage cans, she stepped on road gravel and slipped twisting her left ankle.  She went to LaGrange Medical Center, and the diagnosis was left foot sprain.  She followed up with a podiatrist who diagnosed a left second toe fracture.  On March 27, 2009, Billich underwent surgery to excise a bony fragment on the plantar aspect of the left second metatarsal.  She completed a course of physical therapy and returned to work on August 3, 2009.  She lost 100 days of work.

Subject to the approval of the Illinois Workers’ Compensation Commission, this claim can be settled for the sum of $27,752.06 which represents a 25% loss of use of the left foot.

The General Counsel believes this is an equitable settlement to conclude this matter and requests payment of that sum be approved and he be authorized to execute such documents as may be necessary to effect the settlement.

Requested, Frederick M. Feldman, General Counsel, FMF:LAG:VMM:JLO:nm

Respectfully Submitted, Terrence J. O’Brien, Chairman Committee on Judiciary
